Gov’t launches systematic review to modernise legal codes

Macau authorities are conducting a systematic review of the city’s major codes to modernise its legal framework, Secretary for Administration and Justice Wong Sio Chak told legislators on Wednesday.

According to the secretary, the Administrative Procedure Code would be given priority, with a special task force now advancing legal amendments, which are expected to reach the Legislative Assembly for a vote this year.

Also falling under review are the Civil Procedure Code, Administrative Litigation Code, Penal Code, and the Criminal Procedure Code.

The task force studying the need to update these legal codes includes judges, lawyers, and legal staff in public services, the secretary said.

“They are using their rich knowledge of legal theory and practice to provide technical support for revising the codes, helping the government study and draft amendment plans, and steadily moving the lawmaking process forward,” Wong said.

Findings from the task force’s studies will serve as supporting basis for the forthcoming revisions, with coordination among these different codes taken into consideration.

The government, Wong added, would also draw on experiences from other jurisdictions in a bid to form a set of revisions adapted to Macau’s specific circumstances.

One of the objectives is to make electronic litigation procedures possible and to introduce simplified trial processes.

Analysis results related to the Civil Procedure Code will soon be put up for consultation later this year, while work on the Administrative Litigation Code will proceed accordingly in tandem.

As for the Penal Code and the Criminal Procedure Code, preliminary research is still underway and expected to finish later this year.
